Canadian Federal Court upholds ruling classifying Nigeria’s APC and PDP as terrorist organisations.
Former member Douglas Egharevba was denied asylum due to decade-long affiliation with both parties.
Court cites political violence, electoral bloodshed, and subversion of democracy as grounds for inadmissibility.
The Federal Court of Canada has upheld a decision declaring Nigeria’s two major political parties, the All Progressives Congress (APC) and the Peoples Democratic Party (PDP), as terrorist organisations.
The ruling also denied asylum to Douglas Egharevba, a former member, citing his long-term affiliation with both parties.
Justice Phuong Ngo dismissed Egharevba’s application for judicial review after the Immigration Appeal Division (IAD) found him inadmissible under Canada’s Immigration and Refugee Protection Act (IRPA).
Court documents indicated that both parties were linked to political violence, electoral manipulation, and the killing of opposition supporters, particularly during the PDP’s 2003 state elections and 2004 local government polls.
The tribunal found that party leadership benefited from the violence and took no steps to stop it, meeting Canada’s legal definition of subversion under IRPA. Justice Ngo affirmed that membership in an organisation associated with terrorism or democratic subversion is sufficient to trigger inadmissibility, regardless of personal involvement.
Egharevba’s argument that political violence was widespread across all Nigerian parties was dismissed. Deportation proceedings are expected to follow.
